Terms of Service

These terms govern your use of topspecdesigns.com and the design and development services Top Spec Designs (Anthony Szarpa, Bayonne, NJ) provides. By contacting us or hiring us for work, you agree to what’s on this page. If anything is unclear, email info@topspecdesigns.com and we’ll explain in plain English.

1. What we provide

Top Spec Designs designs, builds, and (optionally) hosts custom websites for small businesses. Specific scope, deliverables, and timeline are agreed in writing for each project before any work starts.

2. Quotes and pricing

Our Basic offering is a flat $500 for a single-page custom site, live in 72 hours. Custom projects are quoted up front and the quoted price is what you pay; we don’t bill hourly add-ons for in-scope work. Out-of-scope changes are quoted separately before they’re started.

3. Payment

Basic ($500): 50% on kickoff, 50% on launch. Custom projects: payment schedule is agreed in writing per project (typically 50% on kickoff, 50% on launch for shorter projects, milestone-based for longer ones). Payment methods accepted: bank transfer, Zelle, credit card. Invoices are due on receipt.

4. Timeline and your responsibilities

We commit to the timeline given in your quote, but timely delivery depends on you returning content (copy, photos, brand assets) and feedback on schedule. If your responses are delayed, the timeline shifts to match. We’ll always tell you what we need and when.

5. Revisions

Basic projects include two rounds of revisions on the design and one round on the build. Custom projects’ revision count is specified in the quote. Additional revisions are billed at a flat per-round rate quoted up front.

6. Ownership of the final site

On full payment, you own the final website: the code, the design as delivered, the content, and the domain. We retain the right to display the work in our portfolio and marketing unless you ask us not to. We keep ownership of any underlying tools, templates, or working files we use internally.

7. Hosting and care plans

If you’ve subscribed to a hosting or care plan, it renews monthly until you cancel. Cancel any time by emailing us; the plan ends at the end of the current billing period. We’ll help you migrate the site to another host if you leave.

8. Third-party services

Your site may rely on third-party services (Netlify hosting, Google Fonts, payment processors, etc.). We’re not responsible for outages, pricing changes, or policy changes from those vendors, but we’ll help you respond when something changes.

9. Warranty

We stand behind our work. If a site we built breaks because of something we did (a bug, a broken link, a layout issue), we’ll fix it free for the first 30 days after launch. After that, ongoing fixes are covered by a care plan or billed per change. Issues caused by changes you (or anyone else) made are not covered.

10. Limits of liability

We do our best work, but no website builder can guarantee specific business results, search rankings, sales, or uptime of third-party services. Top Spec Designs’ total liability for any claim is limited to the amount you paid us in the 12 months before the claim. We’re not liable for indirect or consequential damages.

11. Termination

Either of us can end the engagement at any time with written notice. If you cancel mid-project, you pay for work completed up to that point. If we cancel mid-project for any reason except your non-payment, we refund any deposit not used.

12. Governing law

These terms are governed by the laws of the State of New Jersey. Disputes that can’t be resolved in good-faith conversation will be heard in Hudson County, NJ.

13. Changes to these terms

If we change anything material, we’ll update the “Last updated” date at the top of this page and note it in active project conversations. Existing project agreements stay governed by the terms in effect when the project started.
